Terms of Service

Welcome to Phonetizer ("Service"), operated by Linguistador LLC ("Company", "we", "us", or "our"). By accessing or using phonetizer.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. The Service

Phonetizer provides automated phonetic transcription of English text into the International Phonetic Alphabet (IPA). Transcriptions are generated automatically and may contain errors.

2. Eligibility

You must be at least 13 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

You may use certain features without an account. Creating a free account may provide a higher character limit per transcription and access to transcription history.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@phonetizer.com if you suspect unauthorized access.

4. Subscriptions and Payments

Premium subscriptions may be offered on a monthly or annual basis. Subscription features and limits may be described within the Service and may change over time.

4.1 Billing and Renewal

Subscriptions are billed in advance and renew automatically until canceled. Payment processing is handled by Stripe. We do not store your card details.

4.2 Cancellation

You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to Premium features until that time.

4.3 Price Changes

We may change subscription prices from time to time. If a price change applies to your subscription, we will provide reasonable notice (for example, via email or within the Service) before it takes effect.

4.4 Refunds

Except where required by law, refunds are generally not provided for partial billing periods. If you believe you were charged in error, contact us at support@phonetizer.com.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes or in violation of applicable laws.
  • Attempt to reverse engineer, bypass, or interfere with the Service, security, or rate limits.
  • Abuse, overload, scrape, or disrupt the Service or its infrastructure.
  • Upload or submit content that you do not have the right to use, or that infringes third-party rights.

6. Your Content

You retain ownership of the text you submit. By submitting text, you grant us a limited, non-exclusive license to process, store, and display it solely for the purpose of providing and improving the Service (including maintaining transcription history where applicable).

7. Intellectual Property

The Service, including its software, design, branding, and all related intellectual property, is owned by Linguistador LLC and protected by applicable laws. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted by these Terms.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Linguistador LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses arising out of or related to your use of the Service.

To the extent liability is not excluded, our total liability for any claims arising out of or related to the Service shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.

10. Termination

We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or if necessary to protect the Service, users, or our rights. You may stop using the Service at any time.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice to registered users (for example, by email or within the Service). Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the laws of the state in which Linguistador LLC is registered, without regard to conflict of laws principles.
